Oppopinion time! Which insurance to claim against?

The estimates are in! As expected, they are about the same. For those who don’t remember what I’m talking about, my WRX was t-boned week before last.

Knowing it would take several days for the other party’s insurance, Allstate, to take responsibility (he received a citation for failure to yield), I contacted my insurance, Farm Bureau, so I could get a rental car immediately without out-of-pocket costs. I spoke with Allstate the next day to talk about repairs. We decided to have both companies provide estimates before making a final decision.

Now it’s time to decide which way to file it. If I file with mine, I get better rental coverage ($30/day instead of $20/day), but I have to deal with paying the deductible ($500) and wait for reimbursement from Allstate. I asked the agent about increases to my policy and he said not to be concerned since it was the other party’s fault. I believe him since we went through this with my wife’s Explorer a couple of years ago.

If I file with Allstate, I may have to downgrade to a Corolla or equivalent or pay the difference in cost. The upside is that I won’t have to deal with paying a deductible.

By the way, I did talk to both sides about diminished value. This will be negotiated when the repair is complete. I also talked to the Allstate adjuster about the tires. Since it is AWD, all four tires must be replaced to prevent drivetrain damage from tires with different diameters. This was news to him. I’m pretty sure that is going to be a point of contention.

So, Oppo, what would you do?

The time value of $500 tied up for a few weeks is fairly minimal, so I’d get the better rental coverage.

You should still be able to get an equivalent car from Allstate if you file against them (Due to the fact that they must pay for “loss of use” of your car). And by equivalent, that really means whatever they want it to mean. However, this can work to your advantage.

When I was rear ended in my Mercedes E300, the other party’s insurance wanted to give me a Dodge Avenger (About the only car I outright *refuse* to drive), and I phoned them while I was at the rental place and told them that an intermediate car is in no way equivalent to an E class in terms of size or prestige.

I drove out of the rental agency with a Lincoln Town Car.

I actually wouldn’t care about rental coverage or fronting the $500 very much.

I would be mostly concerned with which insurance company will pay for the best quality body panels/replacement parts. Some will only use OEM if the car is, say, less than 3 years old. Others will go with the cheapest aftermarket stuff they can find regardless of how old the car is.

I live in a no-fault state, so this is all foreign to me.

That being said, I’d pick the option with the lowest out of pocket cost, so I’d probably pick Allstate.

My experience is that I open a claim with my company, go through them for everything, and they go off and recoup from the other guys. Never even talked, personally, to the other party’s insurance. I’ve been rear-ended 4 times in the last 7 years and done it that way every time. If the other insurance is up front accepting responsibility (3 of the times) before the repairs were complete my insurance didn’t make me cover the deductible. If they were dragging their feet (one time) I paid the deductible and it was refunded once the two companies worked it out (<30 days). Never heard anything about disparate rental coverage so I either got lucky or my guys just ate it.

All of the claims were closed once they received payment from the other guys so none of it affected my rates.

So, um, yeah...I recommend doing it that way haha.

This is how it went the last time I got rear-ended. Except it was in a rental car so there was no escaping the deductible. I only spoke to the other insurance company because they called me to apologize and to make sure I knew they would cover everything.
